Cody Harris revels in taking on challenging, novel, and high-stakes civil litigation, including securities, antitrust, trade secret, and consumer class actions, as well as appellate litigation. Whether handling a case in federal court, state court, or in arbitration, Cody believes that top-notch legal analysis, clear and compelling briefing, and persuasive oral argument can mean the difference between an early win – or a legal landscape that will position a client for victory – and a much more challenging case as the lawsuit unfolds.
Cody’s recent representative cases include representing Qualcomm both in a bet-the-company trial and appeal against the Federal Trade Commission, and in follow-on nationwide class action lawsuits alleging both antitrust and securities fraud claims. Cody also successfully represented Genentech as the victim of a massive trade secret theft by its former scientists who founded JHL Biotech to develop biosimilar versions of Genentech’s cancer treatments.
Cody is also proud of his robust pro bono practice, particularly his successful efforts to defend the constitutional separation of powers when the president threated to cut off all federal funding to the County of Santa Clara unless it helped enforce federal immigration directives.
In addition to handling the complex commercial litigation detailed below, Cody also first chaired several trials while serving as an assistant district attorney in the Santa Clara District Attorney’s Office. Moreover, having spent more than a dozen years teaching constitutional law through the Stanford Continuing Studies Program, Cody is used to explaining complicated legal concepts to laymen, a significant advantage when presenting a complex case to a jury.
Prior to attending law school, Cody worked with business clients across a variety of industries as a management consultant, before serving as a communications director for a senior member of Congress.
